Bu konuda iktidara iki kez geri ad\u0131m<br \/>\natt\u0131rmay\u0131 ba\u015faran kad\u0131n \u00f6rg\u00fctlerinin ba\u015f\u0131n\u0131 \u00e7ekti\u011fi toplumsal muhalefet, bu<br \/>\ntasar\u0131y\u0131 da geri \u00e7ektirmekte kararl\u0131. Ma\u011fdurun failiyle evlendirilmesi<br \/>\ndurumunda cezan\u0131n uygulanmamas\u0131n\u0131 \u00f6ng\u00f6ren kanun maddesi, kad\u0131n hukuk\u00e7ular\u0131n<br \/>\nuzun s\u00fcreli m\u00fccadeleleri sonucunda 2005 y\u0131l\u0131nda T\u00fcrk Ceza Kanunu\u2019ndan\u00a0 \u00e7\u0131kart\u0131lm\u0131\u015ft\u0131. Eski TCK\u2019den 1 Haziran 2005\u2019te<br \/>\n\u00e7\u0131kar\u0131lan bu Madde \u015f\u00f6yleydi: \u201cHer kim 15 ya\u015f\u0131n\u0131 dolduran bir k\u0131z\u0131 alaca\u011f\u0131m diye<br \/>\nkand\u0131r\u0131p k\u0131zl\u0131\u011f\u0131n\u0131 bozarsa alt\u0131 aydan iki seneye kadar hapis olunur. Evlenme<br \/>\nvukuu halinde dava ve ceza tecil olunur. \u015eu kadarki be\u015f sene i\u00e7inde koca<br \/>\naleyhine bo\u015fanmaya h\u00fckmolunursa hukuku amme davas\u0131 avdet eder ve evvelce ceza<br \/>\nh\u00fckmolunmu\u015fsa \u00e7ektirilir. Maddenin TCK\u2019den \u00e7\u0131kar\u0131lmas\u0131n\u0131n ard\u0131ndan \u00e7ocu\u011fa<br \/>\ny\u00f6nelik cinsel istismar vakalar\u0131 yarg\u0131lamalar\u0131nda ciddi art\u0131\u015f ger\u00e7ekle\u015fti. Adli<br \/>\nSicil ve \u0130statistik Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn verilerine g\u00f6re, 2006 y\u0131l\u0131nda y\u00fczde<br \/>\n42,5 olan \u00e7ocuk cinsel istismar h\u00fck\u00fcml\u00fclerinin oran\u0131 2016\u2019da y\u00fczde 58,8\u2019e<br \/>\ny\u00fckseldi. Maddenin TCK\u2019den \u00e7\u0131kar\u0131lmas\u0131ndan 11 y\u0131l sonra Diyanet \u0130\u015fleri<br \/>\nBa\u015fkanl\u0131\u011f\u0131\u2019n\u0131n \u201ck\u0131z \u00e7ocuklar\u0131na ailede ve d\u0131\u015far\u0131da \u015fehvet duyulmas\u0131n\u0131n bir<br \/>\nsak\u0131ncas\u0131 olmad\u0131\u011f\u0131na\u201d dair verdi\u011fi fetva tecav\u00fcz\u00fc alenen savunan bir devlet<br \/>\nolma yolunda.<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">K\u00fc\u00e7\u00fck ya\u015fta \u00e7ocuklar\u0131 evlendirme<br \/>\nyetmiyormu\u015f gibi \u015fimdi de cinsel istismara, tecav\u00fcze u\u011frayan \u00e7ocuklar\u0131<br \/>\ntecav\u00fczc\u00fcs\u00fcyle evlendirme tart\u0131\u015fmas\u0131 insanl\u0131\u011f\u0131n bitti\u011fi nokta d\u0131\u015f\u0131nda bir yer<br \/>\nde\u011fildir.\u00a0 Bunu dinle, kanunla yapma<br \/>\n\u00e7abas\u0131 ise ahlaki ve vicdani toplumun t\u00fckendi\u011fi bundan g\u00fc\u00e7 beleyen erke\u011fi tanr\u0131<br \/>\nyerine koyan, kendi h\u0131rs ve iktidarlar\u0131 i\u00e7in kurban etme d\u0131\u015f\u0131nda hi\u00e7 bir \u015fey<br \/>\nde\u011fildir. Kim ne diyorsa desin bunun d\u0131\u015f\u0131nda ba\u015fka bir tan\u0131m\u0131 olamaz. Ama \u015fu<br \/>\nfark\u0131 da g\u00f6z ard\u0131 edilemez. Tanr\u0131ya kurban etme olay\u0131 daha ahlaki bir y\u00f6ntemle<br \/>\nyap\u0131l\u0131rd\u0131. Aradaki farkta budur. insan\u0131 kurban etme k\u00fclt\u00fcr\u00fc daha M.\u00d6. Hz.<br \/>\n\u0130brahim taraf\u0131ndan bin y\u0131llar \u00f6nce ortadan kald\u0131r\u0131lm\u0131\u015f olmas\u0131na ra\u011fmen farkl\u0131<br \/>\nbir versiyonla devam etmektedir. O d\u00f6nemin insan\u0131 kurban etme bi\u00e7imi, anlam\u0131<br \/>\nba\u015fka ama\u00e7lar i\u00e7in yani bir inan\u00e7 u\u011fruna tanr\u0131ya yap\u0131l\u0131rd\u0131. Ama g\u00fcn\u00fcm\u00fczdeki<br \/>\nkurban etme olay\u0131 nas\u0131l bir tan\u0131m getirece\u011fiz acaba.\u00a0\u00a0 Ve<br \/>\n\u00f6yle bir y\u00f6ntem ile yap\u0131l\u0131yor ki ak\u0131llara durgunluk, y\u00fcre\u011fe hi\u00e7 bir<br \/>\n\u015fekilde s\u0131\u011famayacak, dayan\u0131lmas\u0131 imkans\u0131z bir durum. Bu\u00a0 daha korkun\u00e7<br \/>\nbir y\u00f6ntemle ve her y\u00f6n\u00fc ile her g\u00fcn dirim dirim \u00f6ld\u00fcrme yoluyla kurban<br \/>\netmedir. ama ne u\u011fruna? Hangi inan\u00e7 u\u011fruna, hangi tanr\u0131ya?.<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Bu \u00e7ocuklar\u0131n daha ya\u015fama tam anlam<br \/>\nverme \u00e7a\u011f\u0131na gelmeyen, kendi savunmas\u0131n\u0131 bile yapamayan, u\u011frad\u0131klar\u0131<br \/>\nzorlu\u011fu\u00a0 nas\u0131l tedavi edilir, nas\u0131l<br \/>\nya\u015fama daha sa\u011fl\u0131kl\u0131 tutunabilir yerine \u00a0tecav\u00fczc\u00fcs\u00fcyle evlendirme muamelesi g\u00f6rmeleri,<br \/>\ns\u00f6ylenecek her s\u00f6z bile anlam yitimine u\u011fram\u0131\u015ft\u0131r. B\u0131rakal\u0131m bir \u00e7ocu\u011fu<br \/>\nyeti\u015fkin bir insan bile b\u00f6ylesi vah\u015fi bir durumu kald\u0131ramaz, hele bir \u00e7ocu\u011fu<br \/>\nd\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fczde insanl\u0131k ad\u0131na tarifi imkans\u0131zl\u0131kla dop dolu&#8230;<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Bu kararlar\u0131 alanlara cidden sormak<br \/>\nlaz\u0131m kendini acaba bu \u00e7ocuklar\u0131n yerine koyabiliyorlar m\u0131?\u00a0 Bir \u00f6m\u00fcr ruhunu \u00e7alan\u0131n, ya\u015fam\u0131n\u0131,<br \/>\nhayallerini ellerinden alana ayn\u0131 \u00e7at\u0131da ayn\u0131 yatakta\u00a0 ve ya\u015fam\u0131n her an\u0131n\u0131 kendi ya\u015fam katilleriyle<br \/>\nhayatlar\u0131n\u0131 payla\u015fabilirler mi? Bu insanlar\u0131n ruh d\u00fcnyas\u0131nda, duygu d\u00fc\u015f\u00fcnce<br \/>\nd\u00fcnyas\u0131nda nas\u0131l bir tahribat yaratabileceklerini karar al\u0131rken ak\u0131llar\u0131n<br \/>\nu\u00e7lar\u0131nda bir nebze olsun hi\u00e7 d\u00fc\u015f\u00fcnd\u00fcler mi? Bu insanlar\u0131n k\u0131z \u00e7ocuklar\u0131 var<br \/>\nm\u0131d\u0131r acaba?<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Ve en inan\u0131lmaz olan da kad\u0131n ad\u0131na<br \/>\nbu kararlar\u0131 alanlar\u0131n hepsi erkek. \u0130mamlar, m\u00fcft\u00fcler, hakimler, savc\u0131lar ve en<br \/>\nkorkuncu da bu halk\u0131n oylar\u0131yla meclise gelen milletvekilleri. Halk ad\u0131na<br \/>\ninsanl\u0131k ad\u0131na, ya\u015fam\u0131 y\u00fcceltme ve anlamland\u0131rma ad\u0131na yemin eden s\u00f6zde<br \/>\n\u00f6nc\u00fcler, bilginler.<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Neden b\u00f6yle bir y\u00f6nteme<br \/>\nba\u015fvuruyorlar? Peki niye?<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Bunun bir \u00e7ok ahlak d\u0131\u015f\u0131 nedenleri<br \/>\nvard\u0131r. \u00e7\u00fcnk\u00fc ahlakla insanl\u0131kla hi\u00e7 alakas\u0131 izahat\u0131 yoktur.<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Egemen zihniyetin z\u0131vanadan \u00e7\u0131kt\u0131\u011f\u0131<br \/>\nzamanlar, kendini her \u015feyin hakimi g\u00f6rd\u00fc\u011f\u00fc do\u011fay\u0131, kad\u0131n\u0131, gen\u00e7leri ve<br \/>\n\u00e7ocuklar\u0131 her t\u00fcrl\u00fc hakimiyeti alt\u0131na alma ve her t\u00fcrl\u00fc kullanma hakk\u0131n\u0131<br \/>\nkendinde g\u00f6rme s\u00fcre\u00e7leridir. Bunu onursuzca, vicdans\u0131zca kimi zaman dini<br \/>\nkullanarak kimi zorla, kimi zaman da yasalara ba\u011flayarak yapar. \u0130\u015fte b\u00f6ylesi<br \/>\nbir s\u00fcre\u00e7ten ge\u00e7iyoruz.<\/p>\n<p class=\" \" style=\"text-indent: 0cm;\">Dinle baz\u0131 izahatlar da bulunarak<br \/>\ndin ad\u0131na baz\u0131 nedenlere ba\u011flamaya \u00e7al\u0131\u015f\u0131l\u0131yor. D\u00fcnyan\u0131n hi\u00e7 bir dininde<br \/>\nb\u00f6ylesi korkun\u00e7 bir ya\u015fam bi\u00e7imi vaat edilmemi\u015ftir. \u0130slam dinin de asla b\u00f6ylesi<br \/>\nzalimane bir ya\u015fam\u0131 hi\u00e7 bir kuluna reva g\u00f6rmemi\u015ftir. Olsa olsa Emevili\u011fin \u0130slam<br \/>\ndininde olabilir. Hz. Muhammed\u00een \u0130slam dinin de b\u00f6yle bir\u00a0 ya\u015fam bi\u00e7imi hi\u00e7 bir \u015fekil de\u00a0 olmam\u0131\u015ft\u0131r ve yoktur. \u0130slam dininde kad\u0131n\u0131n<br \/>\nyeri her iki cinsin de sayg\u0131nl\u0131k i\u00e7inde beraber bir ya\u015fam\u0131 vaat eder. Bu durum<br \/>\nzina sucunu bile a\u015fan bir husus. Zina\u00a0 ya<br \/>\nbile her iki cinsin su\u00e7 i\u015fleme durumunda sadece kad\u0131n\u0131 de\u011fil erke\u011fi de ayn\u0131<br \/>\ncezaya, yapt\u0131r\u0131ma tabi tutulur. Ama erkek egemen zihniyeti kuran\u0131n ayetlerini,<br \/>\ns\u00fcrelerini kendi \u00e7irkin \u00e7\u0131karlar\u0131na g\u00f6re yorumlay\u0131p toplumu buna inand\u0131rm\u0131\u015flar.<br \/>\nDiyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n \u201ck\u0131z \u00e7ocuklar\u0131na ailede ve d\u0131\u015far\u0131da \u015fehvet<br \/>\nduyulmas\u0131n\u0131n bir sak\u0131ncas\u0131 olmad\u0131\u011f\u0131na\u201d dair verdi\u011fi fetva hangi dinde vard\u0131r<br \/>\nacaba.\u00a0 K\u0131z \u00e7ocuklara \u015fehvetle<br \/>\nbakmak\u00a0 birde aile i\u00e7inde eklemek din<br \/>\nad\u0131na bunu yapmak sap\u0131kl\u0131k de\u011fildir\u00a0 de<br \/>\nne olabilir acaba. Bu bak\u0131\u015f ac\u0131s\u0131n\u0131 yarg\u0131layan, soru\u015fturan ibretlik bir ceza<br \/>\nolarak de\u011ferlendirmeyen zihniyetle nas\u0131l halk\u0131n \u00f6nc\u00fcs\u00fc y\u00f6netici oluna bilinir.<br \/>\nBu \u00e7irkinle sadece kad\u0131nlar\u0131n de\u011fil erkeklerin k\u0131yameti koparmas\u0131 gerekir. Bunu<br \/>\nhangi \u00f6l\u00e7\u00fclere, de\u011ferlere vurursak k\u0131yamet gerek\u00e7esidir.
