Hukuk, Hammurabi\u2019den bu yana yaz\u0131l\u0131 olarak devlet ve iktidar\u0131n belirledi\u011fi s\u0131n\u0131rlar d\u0131\u015f\u0131nda bir ya\u015fam bi\u00e7imine e\u011filim g\u00f6sterilmemesi \u00fczerine kuruludur. Ancak yine de devlet, \u2018son \u00e7are\u2019 olarak elindeki t\u00fcm imkanlar\u0131 paramiliterle\u015fmeye harcamaya ba\u015flam\u0131\u015ft\u0131r. Bunun iki temel sebebi vard\u0131r.<\/p>\n<p>Birincisi, demokratik ve \u00f6zg\u00fcrl\u00fck\u00e7\u00fc direni\u015flerin bast\u0131r\u0131lamay\u0131\u015f\u0131 ve bu direni\u015fler sonucunda halklar\u0131n gittik\u00e7e artan oranda somut kazan\u0131mlar elde etmesidir. \u0130kincisi de bilgiye ve \u00f6rg\u00fctlenmeye h\u0131zl\u0131 ula\u015f\u0131labiliyor olmas\u0131d\u0131r. Sapt\u0131r\u0131lm\u0131\u015f hakikat ve devlet akl\u0131yla in\u015fa edilmi\u015f ger\u00e7ekler her ge\u00e7en g\u00fcn birer birer y\u0131k\u0131l\u0131rken evrensel ve toplumsal hakikati aray\u0131\u015f \u00e7abalar\u0131 da gittik\u00e7e art\u0131yor. Bu nedenle devletlerin paramiliterle\u015fmesi ve paramilitarizmin yerelle\u015fmesine g\u00f6z yummas\u0131, asl\u0131nda gittik\u00e7e kaybolan me\u015frulu\u011funu korumak i\u00e7indir. Devlet ve iktidar\u0131n, \u00f6mr\u00fcn\u00fc uzatmak i\u00e7in uygulad\u0131\u011f\u0131 politikalardan birinci derecede kendisinin sorumlu tutulmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mek ve ortaya at\u0131lacak su\u00e7lardan muaf olmak amac\u0131 g\u00fcd\u00fclmektedir. Ge\u00e7ti\u011fimiz y\u00fczy\u0131lda bile devletlerin bu d\u00fczeyde bir kayg\u0131lar\u0131 yoktu. \u0130\u015fte bu kayg\u0131y\u0131 yaratan da b\u00fcy\u00fcyen direni\u015f hatt\u0131 ve bilginin h\u0131zl\u0131 dola\u015f\u0131m\u0131d\u0131r. Buna kar\u015f\u0131 devlet ve iktidar\u0131n son \u00e7aresi de t\u00fcmden paramiliterle\u015fmektir.<\/p>\n<p><strong>3\u2019\u00fcnc\u00fc D\u00fcnya Sava\u015f\u0131\u2019n\u0131n y\u00fcr\u00fct\u00fcc\u00fc g\u00fcc\u00fc paramiliter yap\u0131lar <\/strong><\/p>\n<p>3.D\u00fcnya Sava\u015f\u0131na giri\u015fi ifade eden 20. y\u00fczy\u0131l\u0131n son \u00e7eyre\u011finden ba\u015flayarak, k\u00fcresel ve b\u00f6lgesel hegemonik iktidar ve devletlerin hem kendi aralar\u0131nda hem de demokratik-\u00f6zg\u00fcrl\u00fck\u00e7\u00fc \u00e7izgiye kar\u015f\u0131 sava\u015f\u0131nda artan oranda teknik silahlar\u0131 kullanmas\u0131, bu a\u00e7\u0131dan teknolojiyi silah ve zor ayg\u0131tlar\u0131n\u0131n geli\u015fimine ko\u015fturmas\u0131, yukar\u0131da belirtilenler kadar, devletlerin, sava\u015ftaki insan ve de\u011fer kay\u0131plar\u0131n\u0131 i\u00e7 politikada anlatamaz olmas\u0131yla da ilgilidir. Fakat t\u0131pk\u0131 eski sava\u015f\u00e7\u0131lar\u0131n dedi\u011fi gibi \u2018Sava\u015f, ancak meydanda kazan\u0131labilir\u2019dir.<\/p>\n<p>Askeri teknik geli\u015fimin de tek ba\u015f\u0131na yetmedi\u011fi, bug\u00fcn d\u00fcnyan\u0131n bir\u00e7ok yerinde ya\u015fanan sava\u015f ve direni\u015flerle kan\u0131tlanm\u0131\u015ft\u0131r. \u00d6nder \u00d6calan\u2019\u0131n \u2018En b\u00fcy\u00fck teknik, insand\u0131r\u2019 belirlemesi, belki de bu nedenle daha fazla \u00f6nem kazanm\u0131\u015ft\u0131r. Paramilitarizm, e\u011fer bir devlet ve iktidar\u0131n, genel anlamda da k\u00fcresel ve b\u00f6lgesel hegemonik g\u00fc\u00e7lerin s\u00f6m\u00fcrgeci, soyk\u0131r\u0131mc\u0131 ve emperyalist ama\u00e7lar\u0131n\u0131 yerine getirmeleri amac\u0131yla bizzat devlet eliyle \u00f6rg\u00fctlendirilip donat\u0131lan ve yetkilendirilen harici askeri yap\u0131lanmay\u0131 ifade ediyorsa bug\u00fcn, bunu yaratan bu ak\u0131l art\u0131k sava\u015f\u0131 paramiliter g\u00fc\u00e7ler olmadan s\u00fcrd\u00fcremiyor. \u00d6zellikle ABD\u2019nin Afganistan ve Irak\u2019taki sava\u015flarda ya\u015fad\u0131\u011f\u0131 s\u0131k\u0131nt\u0131l\u0131 s\u00fcre\u00e7leri \u00f6rnek al\u0131rsak, ba\u015fta yine ABD olmak \u00fczere neredeyse t\u00fcm devletlerin art\u0131k hi\u00e7bir sava\u015fa do\u011frudan ordular\u0131yla girmedi\u011fini g\u00f6rebiliriz. Ordular art\u0131k yard\u0131mc\u0131 g\u00fc\u00e7, teknik destek\u00e7i, e\u011fitimci ya da merkezi komuta gibi rollerle s\u0131n\u0131rl\u0131 tutulmaktad\u0131r.
